DX Penalty Charge Notices are issued by North Devon District Council
If you have received a PCN from North Devon District Council you have a number of options available to you.
Parking - Pay
WITHIN 14 / 21 DAYS
Pay the penalty charge within 14 / 21 days of the PCN being issued at 50% discount.
If your PCN was attached to the windscreen of your vehicle (or sent through the post because the Civil Enforcement Officer was unable to attach the PCN to the vehicle), 14 days should apply. If your PCN relates to a contravention detected on a video camera (e.g. the vehicle was parked at a bus stop, on a red route or in a cycle lane), 21 days should apply.
Your PCN document should provide clarification.
WITHIN 28 DAYS
Pay full penalty charge.
AFTER 28 DAYS
After 28 days, the enforcement authority will issue a Notice to Owner (NtO) requesting the original penalty charge.
AFTER 56 DAYS
After 56 days, a Charge Certificate can be issued and the penalty charge increases by 50%.
AT 70 DAYS
14 days after a Charge Certificate is issued, the enforcement/charging authority can register the PCN as a debt at the Traffic Enforcement Centre.
This may result in a visit from a Civil Enforcement Agent (Bailiff).
Parking Challenge
INFORMAL CHALLENGE
If your PCN was attached to the windscreen of your vehicle (or sent through the post because the Civil Enforcement Officer was unable to attach the PCN to the vehicle), you can make an informal challenge to the enforcement authority against the issued PCN. Your PCN document should explain the process for making an informal challenge if this step applies.
If you make your informal challenge within 14 days of receiving the penalty you should still be able to pay the 50% discounted penalty charge if your challenge is refused.
CHALLENGE THE PCN
The enforcement authority will either accept your challenge and the PCN will be cancelled, OR it will be rejected and you will need to pay the penalty.
You are able to make a further representation; however, you must not pay if you intend to do this.
AWAIT NOTICE TO OWNER / IF PCN RECEIVED BY POST
If the enforcement authority rejects your challenge, you are able to make a formal representation; however, you must await the issue of a Notice to Owner (NtO).
28 days after the PCN was issued, a NtO can be issued to the registered keeper of the vehicle. You can now make your formal representation.
Please note: If the PCN was issued for a contravention recorded by a video camera (e.g. for a vehicle parked at a bus stop, on a red route or in a cycle lane) and sent through the post, this is the first step of the challenge process.
MAKE REPRESENTATIONS
The enforcement authority will either accept your formal representation and the PCN will be cancelled; OR it will be rejected and you will need to pay the penalty.
The enforcement authority may offer the discount period again.
RECEIPT OF NOTICE OF REJECTION LETTER
If the enforcement authority rejects your formal representation, you will receive a Notice of Rejection of Representations letter explaining why.
You can either accept what is said and pay the PCN, OR follow the instructions in the letter about appealing to the Traffic Penalty Tribunal (TPT).
APPEAL TO THE TPT
If you decide not to pay the penalty, you can now appeal to the Traffic Penalty Tribunal (TPT) by following the link in the Notice of Rejection (NOR), or by calling the TPT for a form.
You have 28 days to make your appeal.
APPEAL IS ALLOWED OR DISMISSED
The TPT Adjudicator has reviewed the evidence, as well as statements from the appellant and enforcement/charging authority, and has come to a decision.
If the appeal is allowed, there is nothing to pay and the enforcement/charging authority will cancel the PCN; if the appeal is dismissed, the penalty is still payable and the enforcement/charging authority will continue to enforce the PCN.
Parking Ignore
AFTER 28 DAYS
A Notice to Owner (NtO) will be issued, requiring payment of the full PCN.
AFTER 56 DAYS
A Charge Certificate will be issued, requiring payment of the full PCN + 50%.
AFTER 70 DAYS
The enforcement authority will register the PCN as a debt at the Count Court and pursue. This may result in a visit from a Civil Enforcement Agent (Bailiff).
